TERMS AND CONDITIONS OF THE UA4UA.EU SERVICE
(„Statute”)
- Introductory Provisions
- The administrator of the ua4ua.eu website („Website ” ) is Fundacja im. Loris Malaguzzi with headquarters in Warsaw, ul. Czerniakowska 178/21, 00-440 Warsaw, entered into the register of associations, other social and professional organizations, foundations and independent public health care facilities kept by the District Court for the Capital City of Warsaw in Warsaw, XIII Commercial Division of the National Court Register under number 779463, NIP 5272889533, REGON 383047312 (” Foundation ” or ” Service Provider „).
- The rules for using the Website and services provided electronically by the Foundation are set out in these Regulations.
- Whenever the Regulations refer to:
- User – it ought to be understood as a person using the Website and the services provided within it,
- Services – it ought to be understood as services provided electronically by the Service Provider to Users available on the Website, enabling, among others :
- declaration of willingness to participate in conversations conducted by teachers of the Polish language cooperating with the Foundation,
- establishing contact with the Foundation.
- Rules for using the Website
- The contract for the provision of Services on the Website is concluded between the Service Provider and the User when the User enters the appropriate URL address of the Website in the web browser, while the contract for the provision of Services on the Website is terminated when the User closes the Website.
- The commencement of using any of the Services provided by the Service Provider is tantamount to accepting the Regulations.
- Using the Services does not require registration and login.
- The condition for using the Services is that the User has:
- current web browser,
- Internet connection.
- The use of some Services may also require enabling the SSL secure data transmission protocol, Java Script and cookies support in the browser .
- Applying to participate in conversations in Polish organized by the Foundation
- The website provides the possibility of submitting a willingness to participate in conversations in Polish organized and financed by the Foundation.
- Conversations are conducted under the conditions specified in the Regulations of the educational service (link).
- The user reports willingness to participate in the conversations by filling in the form available at ua4ua.eu. In the application, the User indicates his name, e-mail address, telephone number and information whether the conversation participant is to be an adult or a child (along with information about the child’s age).
- In order to be effective, the application requires authentication by opening the activation link sent to the e-mail address provided in the application.
- The Foundation verifies the received applications and contacts the Users in order to determine the appropriate terms of the conversation for the User.
- Intellectual Property
- The website and the materials published on it are protected under applicable law, in particular the act on copyright and related rights.
- The rights to the works and trademarks made available on the Website are held by the Service Provider or third parties. If third parties are entitled to the rights in question, the Service Provider presents works or trademarks on the Website on the basis of relevant agreements concluded with these persons or on the basis of applicable law in this regard.
- By using the materials available on the Website, the Users do not acquire any rights or obtain a license to these works.
- Without the prior consent of the Service Provider, Users may use the Website and materials only within the permitted use provided for in the Copyright and Related Rights Act.
- Complaints
- The User has the right to lodge a complaint in matters related to the functioning of the Website.
- A complaint should contain the necessary data identifying the User (name, surname, e-mail address or other correspondence address) and a description of the event giving rise to the complaint.
- Complaints should be submitted by e-mail to the address info@ua4ua.eu or by post to the Foundation’s address indicated in point A of the Regulations.
- The Foundation will consider the complaint within 14 days from the date of its receipt, however, the Foundation reserves that the consideration of the complaint may require additional explanations from the User.
- Responsibility
- The User undertakes to use the Services in accordance with applicable law, social and moral standards and the provisions of these Regulations.
- The User is solely responsible for the materials posted on the Website, in particular for any infringement of the rights or goods of third parties and for any damages in this respect.
- Service Provider:
- exercises due diligence to ensure the constant availability and functionality of the Services,
- stipulates that technical problems or technical limitations or the software used by the User may limit or prevent the User from using the Services.
- Personal data
- The administrator of Users’ personal data is the Foundation.
- Users’ personal data are processed by the Foundation on the terms set out in the Privacy Policy [link], and in the case of Users using the conversation subscription form or the contact form – on the terms described in the dedicated information.
- Final Provisions
- In matters not covered by the Regulations, the provisions of Polish law shall apply to the provision of the Services.
- Disputes between the Service Provider and the User who is a consumer regarding the provision of individual Services may be concluded amicably by way of proceedings before an arbitration court on the terms set out in the rules of this court.

UA4UA.EU PRIVACY POLICY

As part of our website, we collect the following information on the use of the website by users:

Personal data of website users are processed on the basis of:
- 6 sec. 1 lit. b) Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (” GDPR ” ) – in order to conclude and perform the contract concluded by the Foundation for the provision of electronic services, handling requests to participate in conversations, handling complaints and other notifications related to the services we provide,
- 6 sec. 1 lit. f) GDPR – as part of our legitimate interest, which is: establishing contact with users, ensuring the security of the website, enabling the investigation or defense against any claims related to the use of the website by users,
- provisions of national law on the protection of personal data and the provision of electronic services.
Due to the fact that the Foundation offers the possibility of subscribing children to the conversations – the Foundation processes their personal data through the website at the request of their parents / legal guardians who report their willingness to use the conversations organized by the Foundation.
The Foundation may entrust the processing or sharing of personal data to entities cooperating with it, in particular providing hosting, maintenance and website development services. These entities gain access to users’ personal data on the basis of personal data entrustment or disclosure agreements concluded by the Foundation.
The Foundation does not profile users’ personal data and does not use automated decision-making.
The period of storage of individual data by the Foundation depends on the type of data and the purpose of its processing. In the case of personal data obtained in connection with the performance of contracts concluded with users (including when you submit a complaint) – this period will most often be the limitation period for any claims arising from a given legal relationship.
Users have the following rights:
- the right to request access to personal data,
- the right to request the rectification of personal data,
- the right to request the deletion of personal data,
- the right to request the restriction of the processing of personal data,
- the right to object to the processing of personal data,
- the right to request the transfer of personal data.

On our website, we use cookies, i.e. small text files saved on users’ devices while using the Foundation’s website.
